Terms & Conditions
These Terms govern use of thecommunitypoint.com (the "Service"), operated by The Community Point. By accessing or using the Service you agree to be bound by these Terms.
1. Operator and acceptance
The Service is operated by The Community Point ("we", "us", "our"). By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the Service.
If you are using the Service on behalf of a homeowners association, community, or business, you represent that you are authorized to bind that organization to these Terms.
2. The Service
The Community Point is a multi-tenant community portal that provides neighborhood information, document storage, event calendars, business directories, AI-assisted answers, and related features. Specific features available depend on your role (resident, administrator, partner) and the plan selected by your community.
We may modify, add, or remove features at any time. We will give reasonable notice of material changes that affect paid plans.
3. Acceptable use
You must not use the Service for unlawful activity, fraud, spam, harassment, infringement of intellectual property, distribution of malware, unauthorized scraping or data mining, security probing, or any activity that interferes with or degrades the Service.
Community administrators are responsible for ensuring uploaded documents and directory content are accurate, lawful, and authorized for publication.
You must keep your login credentials and any community access codes confidential and are responsible for activity under your account.
4. AI-assisted features
AI Concierge responses are generated automatically and may summarize community documents or public information. Responses may be incomplete or inaccurate and are not a substitute for official HOA, management, legal, financial, or emergency guidance.
You are responsible for verifying important information with the HOA, community manager, board, or other official source before relying on it. You must not submit prompts intended to generate unlawful, infringing, harassing, or harmful content.
5. Intellectual property
The Service, including its software, design, branding, and documentation, is owned by The Community Point or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.
You retain ownership of content you submit. You grant us a limited, worldwide license to host, store, display, and process that content solely as needed to provide the Service.
6. Payments — Paddle as Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
By making a purchase, you also agree to Paddle's Buyer Terms (https://www.paddle.com/legal/checkout-buyer-terms), which govern payment, billing, taxes, currency conversion, cancellation, and refund mechanics.
Subscription plans renew automatically at the end of each billing period unless cancelled in advance. Pricing and plan features are shown at checkout.
7. Suspension and termination
We may suspend or terminate access to the Service for material breach of these Terms, non-payment, security or fraud risk, repeated or serious policy violations, or where required by law. Where reasonable, we will provide notice and an opportunity to cure.
You may stop using the Service at any time. Cancellation of paid plans is handled in accordance with the Refund Policy and Paddle's Buyer Terms.
8. Disclaimers and limitation of liability
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.
To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the amounts paid by you to us in the twelve months preceding the claim. We are not liable for indirect, consequential, incidental, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law.
9. Changes and contact
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.
